Check the revocation of land use right certificate issued to people

The Ministry of Natural Resources and Environment requests the People's Committees of the provinces and cities directly under the Central Government to direct the implementation of the revocation of the Guarantee Certificate to not destabilize the local socio-political situation.


The Ministry of Natural Resources and Environment requests People's Committees of provinces and centrally-run cities to inspect the revocation of granted certificates.


The Ministry of Natural Resources and Environment proposes that in case a competent state agency issues a Certificate to withdraw the issued Certificate in contravention of law, People's Committees of provinces and cities needs to direct concerned agencies to strictly comply with the order and procedures for revocation of granted certificates according to regulations.


On August 20, Deputy Minister of Natural Resources and Environment Nguyen Thi Phuong Hoa signed the document No. 4043/BTNMT-TCQLDD to send to the People's Committees of provinces and cities directly under the Central Government to inspect the revocation of the issued certificate.


The content of the official dispatch said that in the recent time, according to some press agencies, some localities had revoked land use right certificates, house ownership certificates and residential land use rights, certificates of house ownership, certificates of ownership of construction works, certificates of land use rights, ownership of houses and other land-attached assets (here-after called a certificate).


According to the Ministry of Natural Resources and Environment, Article 106 of the 2013 Land Law and Article 87 of the Government's Decree No. 43/2014/ND-CP dated May 15, 2014 detailing the implementation of a number of Article 56 of the Land Law, Clause 56, Article 2 of the Government's Decree No. 01/2017/ND-CP of January 6, 2017 amending and supplementing a number of decrees detailing the implementation of the Land Law, revocation of a certificate in case a competent state agency issues a certificate that detects a certificate issued in contravention of the land law must be inspected and notified to the land user again the reason and decision to revoke the issued Certificate.


To ensure the interests of land users and owners of properties attached to land in accordance with the provisions of law, the Ministry of Natural Resources and Environment proposes, in cases where competent state agencies grant certificates of withdrawing issued Certificate which are not in contravention of law, People's Committees of provinces and cities directly under the Central Government should direct relevant agencies to follow the order and procedures for revoking issued Certificate according to the law.


At the same time, the People's Committees of the provinces and cities directly under the Central Government are responsible for directing the revocation of the Guarantee Certificate to not destabilize the local socio-political situation.
